These Terms of Service (“Terms”) govern your access to and use of the Belfolio website and any related services we provide (together, the “Services”). By visiting our site, creating an account, or placing an order, you agree to these Terms.

If you do not agree, please do not use the Services.

Colours may appear different depending on your screen/device
product details may change over time (e.g., packaging updates)
Availability is not guaranteed until an order is accepted

We reserve the right to correct errors (including pricing or product information) even after an order is placed. If a material error affects your order, we’ll contact you with options.

5) Pricing, currency, and taxes

Prices are shown in AUD unless stated otherwise.
Where required, prices may include GST (or this may be shown at checkout depending on your setup).
Shipping fees, if applicable, are shown at checkout before you pay.

We may update prices at any time. Price changes do not affect orders already paid and confirmed (unless there is a clear error, see Section 4).

6) Orders, payment, and order acceptance

A) When an order is accepted

An order is typically considered accepted when:

You receive an order confirmation, and
Payment is successfully processed.

We may cancel or refuse an order if:

payment cannot be verified/processed
Address details are incomplete or appear invalid
we suspect fraud or unauthorised use
an item is out of stock or incorrectly priced due to an error

If we cancel after payment is taken, we will refund you.

B) Payment processing

Payments are handled through third-party payment providers. Belfolio generally does not store full card details. Your payment provider’s terms may apply.

7) Shipping and delivery

Shipping timelines, costs, dispatch rules, and delivery expectations are explained in our Shipping Policy (posted on our website).

Title and risk may pass at the point permitted by law and carrier terms; however, nothing in these Terms limits your rights under Australian Consumer Law (ACL) (see Section 11).

If you enter an incorrect address, you may be responsible for additional re-shipping fees or return-to-sender costs.

8) Returns, refunds, and cancellations

Returns and refunds are governed by our Returns & Refunds Policy (posted on our website). This includes:

30-day change-of-mind returns (subject to conditions)
return process requiring a Return Authorisation (RA) before sending items back
Timelines for lodging returns after approval
rules for faulty, damaged, incorrect, or lost items

Order cancellations:

You may request cancellation before dispatch.
Once dispatched, you will need to follow the Returns & Refunds process after delivery.

If there is any conflict between these Terms and Refunds Policy will apply for return/refund matters.

9) Intellectual property

All content on our Services—including text, images, graphics, logos, product photography, page layout, and design—is owned by or licensed to Belfolio and is protected by applicable intellectual property laws.

You may view and use the site for personal, non-commercial shopping purposes only. You must not:

reproduce, republish, sell, or exploit our content for commercial purposes
remove copyright/trademark notices
Copy product images/descriptions for resale listings without permission

10) Reviews, feedback, and submissions

If you submit reviews, comments, suggestions, photos, or other content to us (“User Content”), you grant Belfolio a non-exclusive, royalty-free licence to use, reproduce, and display that content for legitimate business purposes (e.g., product pages, marketing), subject to applicable law.

You confirm you have the right to submit User Content and that it does not infringe others’ rights.

11) Australian Consumer Law (important)

Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law and other applicable consumer protection laws that cannot be excluded.

Where a product fails to meet a consumer guarantee, you may be entitled to a repair, replacement, or refund depending on the nature of the failure.

12) Disclaimers

To the maximum extent permitted by law:

The Services are provided on an “as is” and “as available” basis.
We do not guarantee uninterrupted or error-free website operation.
We do not guarantee that information on the Services is always complete or current, though we take reasonable steps to keep it accurate.

This does not affect consumer guarantees under the ACL.

13) Limitation of liability

To the maximum extent permitted by law (and subject to the ACL and any non-excludable rights):

Belfolio is not liable for indirect, incidental, special, or consequential loss (including loss of profits, revenue, data, or business opportunity) arising from your use of the Services or products.
Where liability cannot be excluded, it is limited to the extent permitted by law (for example, resupplying services or paying the cost of having them supplied again, where applicable).

14) Third-party links and services

Our Services may include links to third-party websites or tools (e.g., payment providers, carriers, social media). We are not responsible for third-party content, security, or privacy practices. Use third-party services at your own risk and subject to their terms.
